Refund and Cancellation Policy]] --- ## **I.** GENERAL TERMS - The _artist_ has the right to reject any order that they do not want to draw for any reason. - The **client** must remain cordial in communication throughout the commission. > **I.a.** communication will be conducted by [[Contact Me#^2b5450|email]]. --- ## **II.** PAYMENT - Commission requests will only be taken through my [Ko-fi Commissions Page](https://ko-fi.com/turtle_brownie/commissions) - The commission must be paid through _Ko-Fi_. - Complete payment is required for all commissions. - The **client** will pay a total equal to requested price. - Listed prices are subject to change at any time, but the price will not change after it has been paid by the **client**. --- ## **III.** PROCESS AND DELIVERY - Unless the commission type states otherwise, the _artist_ will send updates to review with the **client** to ensure the process is going as expected. - The amount of reviews _**<u>depends on the complexity of the work</u>.**_ - The time it takes to finish a commission <u>varies from days to months</u>, depending on factors such as health, complexity of commissioned piece, other work and personal life of the _artist_. - A commission will take roughly a month at most; A commission that will take longer than this will warrant an email from the _artist_ to the **client**, informing them of the delay. - Once the piece is finished you will receive the full-resolution image, in *PNG* format, via email provided in the **_<u>Ko-Fi request form.</u>_** - Note that there is _**<u>no physical product.</u>**_ The **client** may request additional file types that are readily available (i.e. JPEG, PDF, CSP, etc.) --- ## **IV.** REVISIONS - A fee will be added if the **client** requests something changed on the final drawing, the price depending. - If the **client** wishes for the _artist_ to change something in the drawing the **client** had been have previously satisfied with, the _artist_ is entitled to charge the **client** a fee to change it. The amount of the extra charge depends on the change the **client** requests want me to make. - The **client** is limited to _**<u>2 rounds of revisions</u>**_ at the end of the sketch, line art, colour flats, shaded, an/or render phase, unless the commission type selected specifies no revisions. > **IV.a.** *Sketch* is defined as a drawing containing repetitive or visible construction lines, or very messy lines. These are often early stages of drawings with many stray marks and rough forms. > **IV.b.** *Line Art* is defined as having very little to no visible construction lines. No color or only a single color has been applied to the piece. Attacks with applied overlays and gradients may also fall into this category. > **IV.c.** *Colour Flats* is defined as a drawing that is toned or colored appropriately to match their reference images. There is no evident shading within the drawing. > **IV.d.** *Shaded* is defined as the drawing have shading appearing in one or two places, but is not visible throughout the entire piece. One layer of gradient also counts as minimal shading. > **IV.e.** *Render* is defined as the drawing is consistently shaded, and may be influenced by one or more sources of light. The drawing will have a 'painterly' style, likely with visible brush strokes. This is most indicative of the final piece. --- ## **V.** COPYRIGHT AND USAGE POLICY - The _artist_ claim the rights to the produced drawing, not the **client**. Therefore the _artist_: > **V.a.** Reserves the right to post anywhere, with credit. > **V.b.** Reserves the right to use image for self promotion. > **V.c.** Reserves the right to turn down any project without reason. > **V.d.** Reserves the right to discuss pricing for more complex pieces. > **V.e.** Reserves the right to cancel at any time for any reason. A full refund will be issued, if applicable. > **V.f.** Display it everywhere to their liking > **V.g.** Post it wherever they want - The **client** is allowed to: > **V.h.** Use the commissioned piece for personal use unless agreed otherwise (the **client** may upload it to any social media such as DeviantArt, Instagram, Tumblr, etc. > **V.i.** Print the artwork for personal use and claim the character(s) as their own, _**<u>but not the artwork itself.</u>**_ > **V.j.** Use the artwork to promote themselves. They are not required to give the artist credit when the client posts it. > **V.k.** Use the artwork on their YouTube channel or similar and in monetized videos as long as the artwork itself is not the main reason for the earnings. - The following is considered copyright infringement: > **V.l.** Reproducing/using the copyrighted artwork commercially - means making money off it in any way. > **V.m.** Claiming the artwork as their own > **V.n.** May not make any artistic edits to the commissioned piece unless further commissioned from the _artist_. Cropping/resizing for the sake of formatting for personal use is permitted, however. > **V.o.** The artist reserves the full rights to the image and it's use/distribution unless otherwise agreed upon. > **V.p.** May not convert the artwork or design into NFT or any similar concept. > **V.q.** May not feed my artwork (commissioned or otherwise) into any machine learning or AI based program. --- ## **VI.** REFUND AND CANCELLATION POLICY - If for any reason the _artist_ is unable to start a commission or is for whatever reason unable to complete it, the **client** will receive a full refund. - If the **client** is getting a refund, they will be notified via the email provided in the Ko-Fi commission form. The _artist_ will transfer the money back to the **client** via _**<u>Ko-Fi's refund system.</u>**_ - The **client** may request a cancellation at any time for any reason. Refund will be based around the _**<u> % of work completed, if applicable.</u>**_ - The **client** may not ask for a refund of a completed commission. - If the **client** loses their copy of the completed commission, and the _artist_ does not have a backup copy to resend, the **client** is not entitled to a refund of the commission. --- >[!missing] [[Terms and Conditions#^c9c15a|↑ Back To Top]] --- > _<center>This site is non-profit!
